SOUTH CHARLESTON, W.Va. (WSAZ) -- As if getting a DUI wasn’t enough, a man arrested for driving under the influence got in a lot more trouble at the police station.

Police stopped Jose Cruz on Route 60 in South Charleston Monday night for driving with his headlights off.

Then, he failed sobriety tests and was arrested.

When police were trying to get fingerprints, police say Cruz moved closer to the officer and passed gas on him. The investigating officer remarked in the criminal complaint that the odor was very strong.

Cruz is now charged with battery on a police officer, as well as DUI and obstruction.

Ya know, someone do that shit to me it would me getting arrested for battery because I would stomp the shit out of their face. Serves that vile prick right.

You know the police might have been mistreating him, I mean why else would someone fart on an officer, I find it pretty funny.

I know someone that put a nice log of shit on the treat cart because they didn't like the gaurd.

For some reason I find this to be pretty funny.

Though if I was the officer and had been completely innocent, that bastard would be leaving with a few teeth missing, unless he was funny, then it would probably slide because I'd be laughing too.

Yeah I have to admit, if I were being arrested for a DUI, the thought would probably cross my mind too. "Well fuck it I'm already going to jail, might as well have a better story to tell."
